The Real Cereal Company and any third party that we hire for the purpose of administering, operating, hosting, configuring, designing, maintaining and providing internal support for our services. We collect (but not always store) the following information.

You may be able to sign up to join our mailing list or to receive notifications from us. If you sign up, we may from time to time send you communications with information about our products and services, as well as general information about us. You can unsubscribe at any time by opting out.
We may collect Information from you in the following ways:
Cookies: From time to time, we may use “cookies” to keep track of your visit and your use of the Web Properties and to improve your experience on the Web Properties. Web Beacons: Some of our web pages and electronic communications may contain images, which may or may not be visible to you, known as Web Beacons (sometimes referred to as “clear gifs”). Web Beacons collect only limited information that includes a cookie number; time and date of a page view; and a description of the page on which the Web Beacon resides. These Web Beacons do not carry any Personal Information and are only used to track usage of the Web Properties and activities associated with the Web Properties.
Unique Identifier: We may assign you a unique internal identifier to help keep track of your future visits. We may use this information to gather aggregate demographic information about our visitors, and we use it to personalize the information that you see on the Web Properties and some of the electronic communications you receive from us. We keep this information for our internal use.

Special Offers and Updates
We send all new customers a welcoming email and if necessary, to verify password and username. Established customers will occasionally receive information on (if applicable) products, services, and a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications. Please see the Choice and Opt-out sections.
Newsletters
We may offer a newsletter to our customers, providing information on products, sales and current news related to our products. You can opt out of this at any time.
Service Announcements
On rare occasions it is necessary to send out a strictly service related announcement. For instance, if our service is temporarily suspended for maintenance we might send users an email. Generally, users may not opt-out of these communications, though they can deactivate their account. However, these communications are not promotional in nature.
Customer Service
We communicate with users on a regular basis to provide requested information and in regards to issues relating to their account we reply via email or phone, in accordance with the users wishes.
Other uses
We can use your information to help facilitate requested information, resolve disputes, troubleshoot problems, enforce user agreements, analyze site usage, as well as site content customization, layout and services. No personal information will be used here though.
Sharing

Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on our Web site. While realcereal.com will not rent, sell or share your information in general (except as mentioned in this policy), there are certain instances that your information may be used. We share aggregated demographic information with our partners. This is not linked to any personally identifiable information. This is how your information will be shared:

• Information relating to minors will only be used with prior parental or guardianship approval.
• If realcereal.com merges with another company, then this information will be shared with the merging company.
Third Party Advertisers
While we currently do not work with any third party advertisers, if and when we do, we may share non personal information with third party advertisers, and this will be used to gather information about users for the purpose of targeting our Internet banner advertisements on this site and other sites. The information they collect and share through this technology is not personally identifiable. WHAT INFORMATION IS STORED WITH REALCEREAL.COM.
We only store your name, email address and password on our website. All other information is passed onto the third party involved in sale fulfillment, such as Shopify. These companies have their own privacy policies and its suggested that you contact them if you want more information on how your personal information is stored.
When Information Is Disclosed and Shared
We might disclose Personal Information and/or Usage Information when required by law or in the good-faith belief that such disclosure is necessary:
• To comply with legal processes and applicable law.
• To enforce this Privacy Notice.

The use of your information by a trusted business partner may be subject to that party’s own privacy policy.

Security and User Account
While we may provide certain encryption technologies and use other reasonable precautions to protect your confidential information and provide suitable security, we do not and cannot guarantee or warrant that any information transmitted through the Internet is secure, or that such transmissions are free from delay, interruption, interception or error.
We use reasonable precautions to protect the privacy of your username, password, and User Account information and to ensure that information collected through the Web Properties is not lost, misused, or altered inappropriately by administering security measures. You are ultimately responsible for protecting your username, password and User Account information from disclosure to third parties, and you are not permitted to circumvent the use of required encryption technologies. You agree to: (a) immediately notify us of any unauthorized use of your username, password and/or User Account, and/or any other breach of security; and (b) ensure that you log out from your User Account at the end of each session.
Children’s privacy.
www.realcereal.com is designed for those who can legally create binding contracts. Therefore, www.realcereal.com wants to protect children’s privacy. We comply with the Children’s Online Privacy Protection Act of 1998 and its accompanying FTC regulations.
This children’s privacy statement explains our practices with respect to the online collection and use of personal information from children under the age of thirteen, and provides important information regarding their rights under federal law with respect to such information.
This Site is not directed to children under the age of thirteen and we do NOT knowingly collect personally identifiable information from children under the age of thirteen as part of the Site. We screen users who wish to provide personal information in order to prevent users under the age of thirteen from providing such information. Privacy Outside The Web Properties
The Web Properties may now or in the future contain various links to other websites, including, but not limited to, Shopify, Facebook and Instagram. We are not and cannot be responsible for the privacy practices or the content of any of those websites. Other than under agreements with certain reputable organizations and companies, and except for third-party service providers (as described in this Privacy Notice), we do not share any of the Personal Information that you provide to us with any of third party websites, unless required by our business relationship with them, such as Shopfiy. Please check with those websites in order to determine their privacy policies and your rights under them.
We may use the services of third party service providers (including Shopify) to process transactions on our behalf, including processing your payment for your purchases. By using our Web site, you grant us all necessary rights and consents under applicable laws to disclose to our third party service providers -- or allow those third party service providers to collect, use, retain and disclose to us -- any Personal Information for purposes of providing services and products to you, including data that we may collect directly from you using cookies or other similar means.
GDPR Requirements
GDRP- If required, realcereal.com will comply with the GDRP (General Data Protection Regulation) for users from the European Union, including making sure its clear as to our purposes for processing personal data, where data is stored, our retention periods for that personal data and who it will be shared with. We are not targeting consumers from the EU, but if you are from the EU, and the laws in the US may not be as comprehensive as your own.
CCPA
California Consumer Protection Act (CCPA)- The CCPA took effect on January 1, 2020, and is intended to protect the personal information of California residents. The CCPA has certain threshold requirements which a company must meet in order to be required to comply with its provisions. Upon information and belief, our company does not meet those thresholds. Should the CCPA ever apply to realcereal.com, the following terms shall apply as well (at a minimum):
You have the right to know what personal information we collect from you (which is discussed in this agreement), what third parties we give this information to, as well as the right to request a copy of the information we have from you and how we have used it (twice a year). You also have the right to request that we no longer use (or sell) your personal information, which will be located on our webpages, including making sure its clear as to our purposes for processing personal data, where data is stored, our retention periods for that personal data and who it will be shared with, as well as your rights to your information. You also have the right to not be discriminated against for choosing to opt out.
Opting Out
You are under no obligation to provide any Personal Information to us. However, this information is essential for the provision and quality of some of the services and products that we offer to you, so we cannot provide you with certain services or products, or provide you with access to certain features, if you choose to withhold requested information, for example providing products that require your payment information.

Like many websites and online services, we currently do not alter our practices when we receive a “Do Not Track” signal from a visitor’s browser. Text Marketing and Notifications
If applicable, by subscribing to text marketing notifications you agree to receive recurring automated marketing messages and shopping cart reminder messages at the phone number provided. Consent is not a condition of purchases. Reply STOP to unsubscribe. HELP for help. Msg & Data rates may apply.
If you do not wish to be part of our service you can unsubscribe at any time by texting STOP to any mobile message received from us. You may get another text message confirming your unsubscribing from our service.
Text marketing (if applicable): With your permission, we may send text messages about our store, new products, and other updates. Updates include Checkout Reminders. Webhooks will be used to trigger the Checkout Reminders messaging system.
If your device does not support MMS we will deliver a SMS instead and strip the image.
